E-Agreement for Yana EV Rental Services

Welcome to Yana! By using our electric vehicle (EV) rental services (“Services”), provided through offline methods and our web application (“Yanaride”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). Please read them carefully. If you do not agree with these Terms, do not use our Services.
- Acceptance of Terms By creating an account and using our Services, you agree to these Terms and our Privacy Policy.
- Eligibility
- You must be at least 18 years old.
- You must hold a valid driver’s license.
- You must provide accurate, complete, and updated information.
- Account Registration
- You must create an account to access our Services.
- You are responsible for maintaining the confidentiality of your account information and for all activities under your account.
- Vehicle Usage
- Use the EV in a safe and responsible manner.
- Comply with all traffic laws and regulations.
- Return the EV in the same condition as when it was rented, except for normal wear and tear.
- Report any damage, accidents, or theft immediately to Yana.
- Rental Period and Fees
- The rental period begins when you unlock the EV and ends when you return it to a designated Yana parking location and lock it.
- Rental fees are calculated based on the duration of the rental period and are detailed in our App.
- Additional charges may apply for late returns, damage, or loss of the EV.
- Payment
- You authorize Yana to charge your payment method for all fees incurred during your use of our Services.
- All payments are non-refundable except as required by law.
- Prohibited Activities
- Do not use the EV for illegal activities.
- Do not allow others to use the EV without prior authorization from Yana.
- Do not tamper with or modify the EV.
- Do not operate the EV under the influence of drugs or alcohol.
- Liability and Insurance
- You are responsible for any damage, loss, or theft of the EV during your rental period.
- Yana provides liability insurance coverage as required by law. You may be responsible for additional costs not covered by our insurance.
- Termination
- Yana reserves the right to terminate or suspend your account and access to our Services at any time, without notice, for any reason, including violation of these Terms.
- Limitation of Liability
- To the maximum extent permitted by law, Yana shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services.
- Indemnification
- You agree to indemnify and hold harmless Yana, its affiliates, officers, agents, and employees from any claims, damages, liabilities, and expenses arising out of or related to your use of our Services.
- Governing Law
- These Terms shall be governed by and construed in accordance with the laws of the State of Odisha, without regard to its conflict of law principles.
- Changes to Terms
- Yana may update these Terms from time to time. We will notify you of any changes by posting the new Terms on our App. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

Cancellation & Refund Policy

- Cancellations will be considered only if the request is made immediately after placing the order. However, the cancellation request may not be entertained if the orders have been communicated to the vendors/merchants and they have initiated the shipping process.
- We do not accept cancellation requests for perishable items etc. However, a refund/replacement can be made if the customer establishes that the quality of the product delivered is not good.
- In case of receipt of damaged or defective items, please report the same to our Customer Service team within 2 days of receipt. The request will be entertained once the merchant has checked and determined the same.
- In case of complaints regarding products that come with a warranty from manufacturers, please refer the issue to them.
- In case of any refunds approved by YANTRON TECHNOLOGY PRIVATE LIMITED, it will take 3-5 days for the refund to be processed to the end customer.
By using Yana’s Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
